facts = Steals a credit card - does no use credit card for himself - but buys medicine for his sick grandmother.





issues = Even though his intent is good towards his grandmother - he took property that was not his to complete his task. If I were faced with a chance to save my grandmother's life - I too would select jail over her death. The least of two evils; (steal and grandmother gets well)(don't steal and grandmother dies)





Guilty. He commented the crime. He knew what he was doing was wrong, and he did it anyway. He knew that he would get caught and punished. Retributivism states that there must be punishment. Some have stated that we have a duty, not just a right, to punish criminals. Theft is against the law. So the accused if convicted would be found guilty. A conviction would be based on evidence. The sentence is another matter, there is some wriggle room there, then circumstances would be considered, unless there is a mandatory minimum sentence. Sometimes the law and ethics don't necessarily go hand in hand.
The fact is, you stole, which is illegal. If you want a judge to go easy on you, you need to prove there was no other way, or persons, that could have gotten the medicine for her. You will always be guilty, but may get a lesser sentence depending on your proof.
